Want a short explanation? Remember (in my earlier blog) that lawyers are fighting 60-200 cases simultaneously.
On an average day, two to three hundred pages of paper can arrive in the mail, by courier, or via fax. This lawyer has to read every single document, then sort it, and drop it in the "to file" out-box. A filing clerk files each document, hopefully, in the right file.

The filing clerks, usually paid minimum wage, or nothing (unpaid co-op students) may lose the document, or file it in the wrong file. These documents are often important evidence.

For filing clerks, even more difficult to handle are videotapes, audiotape recordings, and other non-paper items. Often, these are irreplaceable pieces of evidence.

LESSON FOR THE CLIENT: Always keep a copy of every item you give your document.
